DMCA Policy

Introduction to DMCA Compliance

At PakLearning.com, we take copyright infringement seriously and are committed to complying with the Digital Millennium Copyright Act (“DMCA”) of 1998, a U.S. copyright law that provides recourse for copyright owners who believe that material appearing on the internet infringes upon their rights under U.S. copyright law. This policy outlines the procedures for reporting alleged copyright infringement occurring on PakLearning.com and explains the steps we will take in response to such reports.

Reporting Copyright Infringement

If you believe that content hosted or made available via PakLearning.com infringes upon your copyright, you, or an authorized representative, may submit a notification to us requesting that the infringing content be removed or access to it be disabled. To be valid, your notification must be in writing and include the following specific elements as mandated by the DMCA:

Required Information for a Valid DMCA Notice

  1. Identification of the Copyrighted Work:
Provide a comprehensive description of the copyrighted work that you claim has been infringed. Include details such as the title of the work, the type of work (e.g., text, image, video), and any registration numbers or URLs where the original authorized material is located.
  2. Identification of Infringing Material:
Clearly identify the specific material that you believe infringes your copyright on PakLearning.com. You should provide the precise URL(s) or a detailed description of where the material is located on our website. Including at least one search term or reference that appears in our search results will help us quickly locate the alleged infringing material.
  3. Contact Information of the Complainant:
Provide your full legal name, mailing address, telephone number, and a valid email address where we can contact you. This information is essential for us to communicate with you regarding the alleged infringement and our actions in response.
  4. Statement of Good Faith Belief:
Include a statement that you have a good faith belief that the use of the copyrighted material, as described, is not authorized by the copyright owner, their agent, or the law. This statement is crucial for us to understand the basis of your claim.
  5. Accuracy and Authorization Statement:
A statement affirming that the information contained in your notice is accurate and, under penalty of perjury, that you are either the copyright owner or authorized to act on behalf of the owner of an exclusive right that is allegedly infringed. This helps protect both parties from false claims.
  6. Physical or Electronic Signature:
The notice must be signed by you or your authorized representative. An electronic signature is acceptable if the notice is sent via email.

How to Submit Your DMCA Notice

To ensure proper handling of your DMCA notice, please submit the complete information listed above to us via the following methods:

  • Email: Send your notice to [email protected] with the subject line “DMCA Complaint”.
  • Contact Form: You may also use the contact form available on our website under the “Contact Us” section. Be sure to include all the required information listed above.

Processing of DMCA Notices

Upon receiving a valid DMCA notice, PakLearning.com will:

  • Promptly acknowledge receipt of the notification via email to the complainant.
  • Investigate the claim and determine whether the material in question is infringing and should be removed or access to it disabled.
  • Notify the user or content provider responsible for the material in question that we have received a DMCA notice regarding their content, and provide them with an opportunity to respond with a counter-notice, if applicable.

Counter-Notice Procedure

If you receive a notification that your content has been removed or disabled due to a DMCA complaint, and you believe that your content was wrongly removed or that you have the right to use it, you may submit a counter-notice to us. Your counter-notice must include the following information:

  1. Identification of Removed Material: Clearly identify the material that has been removed or disabled and specify where it appeared on PakLearning.com before it was removed.
  2. Statement of Good Faith: Include a statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification.
  3. Contact Information: Provide your full legal name, mailing address, telephone number, and a statement that you consent to the jurisdiction of the federal court in your district (or, if outside the U.S., in the jurisdiction where your service provider may be found).
  4. Physical or Electronic Signature: The counter-notice must be signed by you or your authorized representative.

Submission of Counter-Notice

Send your counter-notice to [email protected] with the subject line “DMCA Counter-Notice”.

Response Time and Follow-Up

We aim to respond to all DMCA notices and counter-notices within seven business days. Please note that emailing your complaint or counter-notice to other parties, such as our Internet Service Provider, will not expedite your request and may delay the process due to incorrect filing.

Important Legal Considerations

Misrepresentation of Claims

Please be aware that any person who knowingly and materially misrepresents that material or activity is infringing may be liable for damages (including costs and attorneys’ fees). You may want to seek legal advice before submitting a DMCA notice or counter-notice.

Repeat Infringers

PakLearning.com reserves the right to terminate user accounts that are found to be repeat infringers. If a user is found to have repeatedly infringed upon copyright laws, we will take appropriate action, which may include disabling access to the user’s account or permanently terminating it.
